VIVIANxCO Terms & Conditions

This contract includes a limitation of liability and a limitation of remedies.
By booking with VIVIANxCO LLC ("VIVIANxCO," "we," "us," "our"), submitting a deposit, or using www.vivianxco.com (the "Site"), you acknowledge that you have read, understand, and agree to these Terms & Conditions ("Terms"). You are contracting with us to create a unique, handmade keepsake using your own flowers as a natural material — this means your finished piece will be one of a kind and will differ in some ways from your original fresh bouquet.
1. Booking & Deposits
A $100 non-refundable deposit reserves your event date and holds your place in our production calendar. This deposit is applied toward your final order total.
There is no minimum order amount — you're welcome to select keepsakes that fit your budget and vision.
Booking your date does not require you to finalize every keepsake selection immediately; final selections are generally due by the time we receive your flowers.
Preservation availability is limited and subject to our current booking capacity. Booking your date does not guarantee a specific turnaround time.
2. Pricing & Payment
Remaining balance is invoiced once we receive your flowers and is due within two (2) weeks of the invoice date, unless otherwise agreed in writing. Your final invoice will include applicable sales tax.
Fresh bouquet pressing carries an additional $50 fee.
We accept payment via Stripe or Zelle. A 2.5% processing fee applies to balance payments made by card through Stripe.
Production and design begin once required payment terms are met. Delayed payment may delay your order.
We reserve the right to update our pricing at any time for future orders. We do not typically increase pricing on an order once a deposit has been made — your deposit locks in current pricing for your order. Any changes, upgrades, or additional pieces added to your order beyond what was priced at booking will be billed at pricing current at the time that addition is made.
We make every effort to accurately display our products and their colors on the Site, but we can't guarantee that any device's screen will display colors with complete accuracy. We also reserve the right to correct any pricing or descriptive errors on the Site without obligation, even after an order has been placed.
We reserve the right to decline or limit service to anyone, at any time, for any reason.
3. Turnaround Time
Standard turnaround is up to approximately six (6) months from the date we receive your flowers, especially during peak wedding season. Turnaround times are estimates, not guarantees, and may vary based on order volume, flower complexity, and season.
4. Sending Your Flowers to Us
Getting your flowers to our studio — whether shipped or dropped off — is your responsibility, and any cost involved is yours to cover. We recommend an overnight or expedited carrier.
Please make sure the name on your shipped package matches the name your deposit was made under, and include your completed client form with your flowers (or email it to us separately) so we can match your flowers to your order. We are not responsible for delays or errors caused by a shipment we can't match to a client form or deposit.
We are not responsible for flowers damaged, delayed, or lost in transit before they reach our studio. We'll work with whatever we receive in good faith, but we can't guarantee results for flowers that arrive in poor condition.
Any flowers we cannot identify, or that go unclaimed after we've reached out to you, will be held at our studio for 60 days, after which they will be disposed of.
We reserve the right to decline to preserve flowers that arrive too damaged, wilted, moldy, or decayed to produce a satisfactory result. In that case, we are not responsible for returning the flowers, and we'll reach out to walk you through your options, which may include cancellation under Section 7.
If you'd like a ribbon, pin, photo, charm, or other personal item incorporated into your piece, you must tell us in writing (via our booking or design form) in advance. Items we aren't told about ahead of time may be missed during production, and we are not responsible for personal items that are lost, damaged, or ultimately can't be incorporated into the design.
5. The Nature of Flower Preservation (Please Read Carefully)
Flower preservation is a handmade process using natural materials, and the outcome cannot be fully controlled or guaranteed. By booking with VIVIANxCO, you acknowledge and accept that:
Flowers naturally change during the drying and preservation process.
Certain flowers may darken, lighten, become translucent, bruise, or shift in color. Color correction may be used at our discretion.
Small bubbles can occur within resin pieces as part of the handmade process.
Some flowers may react with resin in ways that create visual changes.
Resin will naturally amber (yellow slightly) over time. We use UV-resistant resin, but recommend keeping pieces out of prolonged direct sunlight and out of long-term storage in their shipping box.
Some flower varieties preserve better than others, and succulents generally cannot be preserved.
Because every piece is handmade from natural material, we may be unable to incorporate every bloom you send us — how thick or fragile a flower is, and how much room your chosen design allows, both play a part.
Not every flower we receive will necessarily be used in your final piece(s). To make sure we have enough strong material to work with, we routinely preserve extra or backup flowers. Any flowers left over once your order is complete remain with VIVIANxCO and are not shipped back to you, unless you've arranged otherwise with us in advance.
These characteristics are normal results of handmade resin and natural material preservation and are not considered defects.
6. Design Selections & Approval
Design requests — including specific flower placement, exclusions, color preferences, or personal items to include — must be submitted in writing through our design form, email, or booking form. Requests made only by phone call or text are not considered official and may not be reflected in your finished piece.
If we reach out for your design selections or approval and don't hear back within 10 business days, we reserve the right to move forward using our professional judgment, based on your order details and any information already on file.
Because each piece is an artistic interpretation of your flowers and photos, we can't guarantee an exact match to a specific reference photo. We ask that you avoid sending us heavily edited or filtered photos of your bouquet, since they don't reflect the flowers' true colors.
7. Cancellations & Refunds
The $100 booking deposit is non-refundable under all circumstances, as it reserves your event date and holds our limited production capacity.
Once your remaining balance has been paid, your order is non-refundable in full — this applies whether or not production has started at the time of cancellation.
Not caring for the finished piece based on personal taste alone — as opposed to an actual workmanship defect — does not qualify for a refund, remake, or return. We encourage you to review our portfolio and this page before booking so you have a clear sense of what to expect.
Refunds, remakes, or repairs for genuine workmanship issues (as opposed to the normal preservation characteristics described in Section 5) will be evaluated on a case-by-case basis.
VIVIANxCO reserves the right to decline or cancel an order at our discretion — for example, if we determine we're not able to deliver a satisfactory result, or if the working relationship isn't a good fit. In that case, we'll only retain payment for work already completed.
8. Shipping & Local Pickup
Completed orders ship via UPS. A signature is not required for delivery unless you request one in advance.
Before shipping your completed order, we will confirm your mailing address with you. Once your order ships, we'll send you a tracking number and the address it was shipped to — it's your responsibility to review this information and notify us right away if anything is incorrect. It's also your responsibility to ensure someone is available to receive your package, or to arrange for it to be held, as we are not responsible for packages affected by a missed delivery.
We are not responsible for pieces lost, stolen, delayed, or damaged in transit once they've left our studio, though we will assist you in good faith with any carrier insurance claim.
If your piece arrives damaged, please notify us in writing within 48 hours of delivery, with photographic evidence. Repairs may incur additional costs depending on the extent of damage.
Resin art is handmade but not indestructible. Damage caused by improper handling, drops, or misuse after delivery is not covered.
We are unable to release a completed order for shipment or pickup while any balance remains unpaid.
Local Pickup. If you've arranged to pick up your completed order from our studio, we'll notify you once it's ready. We ask that you pick up your order within 2 weeks of that notice. If your order isn't picked up within that window, a storage fee may apply for each additional week it remains with us, unless we've discussed and arranged a different timeline in advance — for example, if you're traveling or otherwise unavailable. Just reach out to us and we're happy to work with you.
9. Media, Photography & Marketing Use
We may photograph your finished piece and use those images — along with any photos you send us of your bouquet or event — for our marketing, portfolio, and social media, unless you notify us in writing that you'd like to opt out. We're happy to keep your identity confidential in any such use upon request.
10. Intellectual Property
All designs, product photography, and content on this Site are owned by VIVIANxCO and may not be reproduced, scraped, or used for commercial purposes without our written permission.
11. Disclaimer of Warranties
VIVIANXCO PROVIDES ALL PRESERVATION SERVICES ON AN "AS-IS" BASIS. WE SPECIFICALLY DISCLAIM ANY AND ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. BECAUSE OUR WORK INVOLVES NATURAL, ORGANIC MATERIAL, WE DO NOT WARRANT THAT COLORS, SHAPE, OR APPEARANCE WILL REMAIN IDENTICAL TO YOUR FRESH FLOWERS OVER TIME.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, VIVIANXCO'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR ORDER SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THAT ORDER. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING SENTIMENTAL VALUE BEYOND THE COST OF THE ORDER ITSELF, REGARDLESS OF THE LEGAL THEORY ASSERTED. Because some states do not allow the exclusion or limitation of certain damages, some of the above limitations may not apply to you, in which case our liability will be limited to the maximum extent permitted by applicable law.
13. Care & Safety
Preserved pieces are intended for indoor display only and are not intended for outdoor use. Keep pieces away from direct sunlight, extreme heat or cold, and high-humidity areas such as kitchens and bathrooms. Resin pieces are heavy and pressed pieces are fragile — please keep them out of reach of children and pets. VIVIANxCO is not responsible for injury or damage resulting from a piece being used or displayed outside of its intended purpose.
14. Indemnification
You agree to indemnify and hold VIVIANxCO harmless from any claims, damages, or expenses arising from your breach of these Terms or misuse of the Site.
15. Governing Law & Venue
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the jurisdiction of those courts.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be construed to reflect the parties' original intent, and the remaining provisions will remain in full force and effect.
17. Entire Agreement
These Terms, together with any separate signed contract for your specific order, constitute the entire agreement between you and VIVIANxCO regarding your order and supersede any prior discussions or communications, whether oral or written. Any ambiguity in these Terms will not be construed against VIVIANxCO simply because we drafted them.
18. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices or operations. The "Last updated" date above reflects the most current version. Continued use of our Services after changes are posted constitutes acceptance of the updated Terms.
