This Privacy Policy describes how VIVIANxCO LLC ("VIVIANxCO," "we," "us," or "our") collects, uses, and discloses information when you visit www.vivianxco.com (the "Site"), submit a booking or inquiry, place an order, or otherwise communicate with us (collectively, the "Services").

By using the Site or our Services, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Site.

1. Information We Collect

Information You Provide Directly

  • Contact details — name, email address, phone number, mailing address

  • Booking and order information — event date, event type, product selections, notes about your bouquet, flowers, or keepsake preferences submitted through our booking/inquiry form

  • Shipping information — the address you provide when sending flowers to our studio, and the address we ship finished pieces to

  • Payment information — your $100 deposit and any remaining balance paid by card are processed securely by Stripe. A 2.5% processing fee applies to balance payments made via Stripe. You may also choose to pay your remaining balance via Zelle. We do not store full card or bank account numbers on our own systems.

  • Communications — anything you send us by email, our contact or booking forms, phone, text, or social media

  • Photos you may voluntarily send us of your bouquet, event, or flowers

Information Collected Automatically

When you visit our Site, our website platform (Squarespace) automatically collects certain technical information — such as IP address, browser type, device information, pages visited, and time spent on pages — using cookies and similar technologies, to help the Site function and to help us understand how visitors use it.

We also use Google Analytics to help us understand website traffic and usage patterns. Google Analytics may collect information such as your IP address, device and browser information, pages visited, and how you interact with our Site, using cookies and similar technologies. You can learn more about how Google handles this data at https://policies.google.com/privacy, and you can opt out of Google Analytics tracking using the Google Analytics Opt-out Browser Add-on.

We may also use paid social media advertising (such as Meta/Facebook ads), remarketing services, and SMS/text marketing to reach current and prospective clients.

Text messaging. If you provide your phone number and check the SMS opt-in box on our booking form (or otherwise affirmatively opt in), you consent to receive text messages from VIVIANxCO, including appointment reminders, shipping updates, and promotional messages. Message and data rates may apply, and message frequency varies. You can opt out at any time by replying STOP to any text, and you can reply HELP for assistance. Consent to receive texts is not a condition of purchase.

Remarketing and advertising services may use cookies, pixels, or similar technologies to show you relevant ads based on your visit to our Site.

2. How We Use Your Information

We use the information we collect to:

  • Respond to booking inquiries and process your order

  • Communicate with you about your event, shipment, invoice, and order status

  • Process payments, deposits, and invoices

  • Coordinate the shipping of flowers to our studio and finished pieces back to you

  • Improve our Site, products, and Services

  • Send occasional marketing or promotional emails, if you've opted in (every email includes an unsubscribe option)

  • Comply with legal obligations, resolve disputes, and protect our business, staff, and clients

3. How We Share Your Information

We do not currently sell or share your personal information for cross-context behavioral advertising. We share information with:

  • Service providers who help us operate — including Squarespace (website hosting), Stripe (payment processing), Google Analytics (website analytics), our shipping label/carrier providers, and email or invoicing tools

  • Advertising and marketing partners, if and when we begin running paid social media ads, remarketing, or SMS marketing (see Section 1 above for details)

  • Legal authorities, if required to comply with a law, subpoena, court order, or other legal process

  • A successor business, in the event VIVIANxCO is sold, merged, or transferred

Each service provider has its own privacy practices governing how it handles your data.

4. Cookies

Our Site uses cookies and similar tracking technologies, provided through Squarespace, to operate properly, remember preferences, and understand site usage. You can control or disable cookies through your browser settings; doing so may affect how parts of the Site function.

5. Data Retention

We retain your personal information for as long as needed to fulfill your order, maintain business and tax records, resolve any disputes, and comply with our legal obligations.

6. Your Choices

You can opt out of marketing emails at any time using the unsubscribe link in any email, and opt out of text messages at any time by replying STOP. (See Sections 8 and 9 below for additional data rights available to California and other U.S. residents.)

7. Children's Privacy

Our Site and Services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13, consistent with the Children's Online Privacy Protection Act (COPPA). If we learn that we've inadvertently collected personal information from a child under 13, we will promptly delete it. 8. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you may have the following rights regarding your personal information under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA):

  • Right to know what personal information we collect and how we use and share it

  • Right to access a copy of your personal information

  • Right to delete your personal information, subject to certain legal exceptions

  • Right to correct inaccurate personal information

  • Right to opt out of the sale or sharing of personal information, including for cross-context behavioral (targeted) advertising

  • Right to non-discrimination for exercising any of these rights

We do not currently sell or share personal information. If we begin using remarketing, retargeting, or similar advertising services that qualify as "sharing" under California law, we will provide a "Your Privacy Choices" or "Do Not Sell or Share My Personal Information" link on our Site, and we will honor Global Privacy Control (GPC) signals as an opt-out request where legally required.

9. Privacy Rights for Residents of Other States

Depending on where you live, you may have similar rights under your state's privacy law (for example, Virginia, Colorado, Connecticut, Texas, and other states have each passed their own consumer privacy laws with varying requirements and thresholds). Rather than address each state's law individually, we extend the same core rights described above — access, deletion, correction, and opt-out of sale, sharing, or targeted advertising — to residents of any U.S. state, regardless of whether your specific state's law currently applies to a business of our size. 10. CalOPPA Disclosures

In accordance with the California Online Privacy Protection Act (CalOPPA):

  • This Privacy Policy is publicly available on our Site.

  • Any changes to this Privacy Policy will be posted here with an updated "Last updated" date.

  • You may contact us to review, update, or request changes to your personal information.

  • Our Site does not currently respond to browser "Do Not Track" signals, as there is no universally accepted standard for how businesses should respond to them.

11. Security

We take reasonable measures to protect your personal information, but no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

12. Third-Party Links

Our Site or communications may contain links to third-party websites (such as social media or shipping carriers). We are not responsible for the privacy practices of those third parties.

13. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or for legal reasons. The "Last updated" date above reflects the most recent version. Continued use of the Site after changes are posted means you accept the updated policy.
